STATE OF MAINE HANCOCK, SS. SUPERIOR COURT LOCATION: ELLSWORTH DOCKET NO. RE-2017-25 U.S. Bank Trust, N.A., as Trustee for LSF9 Master Participation Trust Plaintiff vs Rolph Douglas Carey and Penelope H. Wheeler Defendants Upon review of the Plaintiff's ex parte Motion to Serve the Co-Defendant, Penelope H. Wheeler, by Publication and the Complaint of Foreclosure, the Court finds that the Plaintiff has commenced a civil action to foreclose a mortgage on real estate located at 33 Mills Point Road Brooksville, ME 04617, more particularly described in a mortgage deed recorded in the Hancock County Registry of Deeds in Book 5204, Page 260, and that the foreclosure action will affect the interest of the Co-Defendant in said real property; and that after due diligence, the Plaintiff has been unable to serve the Defendant. It is therefore ORDERED a) The Plaintiff's Motion is Granted; b) That this Order, containing the Summons set forth below, shall be published once a week for (3) successive weeks in the Bangor Daily, a newspaper of general circulation in Hancock County; c) That a copy of this Order, as published, shall be mailed to the Co-Defendant at her last known mailing address by U.S. Mail, postage prepaid; and d) At the direction of the Court, this Order shall be incorporated into the docket by reference. Rule 79(a) SUMMONS TO THE CO-DEFENDANT PENELOPE H. WHEELER U.S. Bank Trust, N.A., as Trustee for LSF9 Master Participation Trust has begun a lawsuit in the Superior Court for Hancock County in order to foreclose a mortgage granted by you dated April 27, 2009, and recorded in the Hancock County Registry of Deeds in Book 5204, Page 260. If you wish to oppose this lawsuit, you or your attorney must prepare and serve a written Answer to the Complaint within forty-one (41) days after the first publication of this Summons. You may obtain a copy of the Complaint from the Plaintiff's attorney, John A. Doonan at Doonan Graves and Longoria, 100 Cummings Center Suite 225D, Beverly MA 01915. You or your attorney must serve your Answer by delivering a copy of it in person or by mail to the Plaintiff's attorney whose name and address appear above. You or your attorney must also file the original of your Answer by mailing it to the office of the Clerk of the Superior Court, Hancock County Superior Court, 50 State Street, Suite 2, Ellsworth ME 04605 before or within a reasonable time after it is served. IMPORTANT WARNING: IF YOU FAIL TO SERVE AN ANSWER WITHIN THE TIME STATED ABOVE, OR IF, AFTER YOU ANSWER, YOU FAIL TO APPEAR AT ANYTIME WHEN THE COURT NOTIFIES YOU TO DO SO, A JUDGMENT BY DEFAULT MAY BE ENTERED AGAINST YOU IN YOUR ABSENCE FOR THE RELIEF DEMANDED IN THE COMPLAINT, WHICH INCLUDES FORECLOSURE OF YOUR INTEREST IN SAID REAL ESTATE IN BROOKSVILLE, MAINE. IF THIS OCCURS YOU WILL LOSE ALL OF YOUR INTEREST IN THE REAL ESTATE AND ANY EXCESS PROCEEDS OF THE FORECLOSURE SALE. YOU MAY ALSO BE FOUND LIABLE FOR ANY DEFICIENCY REMAINING DUE AFTER THE SALE. IF YOU INTEND TO OPPOSE THIS LAWSUIT, DO NOT FAIL TO ANSWER WITHIN THE REQUIRED TIME. If you believe the Plaintiff is not entitled to all or part of the claims set forth in the Complaint, or if you believe you have a claim of your own against the Plaintiff, you should talk to a lawyer.
