By virtue of and in execution of a Judgment of Foreclosure and Sale issued in the Penobscot County District Court dated April 6, 2017, and entered on the docket on April 10, 2017, in Civil Action Docket No. RE-2015-0002 brought by Charles F. Gibbs, Plaintiff, against Jane E. Hudson and ANA Corporation, Defendants, and State of Maine Department of Labor and City of Brewer, Parties-in-Interest, for the foreclosure of a mortgage dated March 26, 2012 and recorded in the Penobscot County Registry of Deeds in Volume 12767, Page 156, the statutory ninety (90) day period of redemption having expired without redemption, notice is hereby given that there will be a public sale on Thursday, August 31, 2017 at 9:30 a.m. at the offices of Lanham Blackwell & Baber, P.A., 133 Broadway, Bangor, Maine 04401, of all and singular the premises described in said mortgage and being a certain lot of land with the buildings thereon, situated in the City of Brewer, County of Penobscot, and State of Maine, described in said mortgage as being located at 554 South Main Street.
TERMS OF SALE: Pursuant to Title 14 M.R.S.A. § 6323, the public sale shall be held not less than Thirty (30) days nor more than Forty-five (45) days after the first date of publication. The mortgagee, Charles F. Gibbs, by virtue of the aforementioned mortgage, shall sell the premises to the highest bidder at the public sale and deliver a deed of such sale to the purchaser, which deed will convey the premises free and clear of all interest of the lien of State of Maine Department of Labor, joined in this action, but subject to a prior mortgage given by the Defendant to the Penobscot County Credit Union dated February 19, 2010 and recorded in Book 12062, Page 57 of said Registry. The mortgagee, or his designees conducting the sale, disclaim any responsibility for providing notice of any kind to any person subsequent to the public sale on Thursday, August 31, 2017, at 9:30 a.m. at Lanham Blackwell, P.A., 133 Broadway, Bangor, Maine 04401. No deposit will be required to bid at the sale, however, a non-refundable deposit of Ten Thousand Dollars ($10,000.00), in the form of certified funds, will be required at the time of the highest bid acceptance/close of sale. The successful bidder shall be required to execute a Purchase and Sale Agreement with Plaintiffs with the aforesaid Ten Thousand Dollars ($10,000.00), as a non-refundable and non-interest bearing deposit thereon providing for a closing within thirty (30) days of the date of the public sale, at which time the balance of the bid price will be due and payable in cash or certified funds payable to Charles F. Gibbs, who will then deliver a duly executed quitclaim deed. The sale shall be made subject to: (a) any condition which a title search would reveal, (b) any unpaid taxes or assessments due to the City of Brewer, and (c) any facts which an accurate survey of the premises might show. The property shall be sold "as is" and "where is" without any warranties whatsoever expressed, implied or otherwise. All other terms are to be announced at the sale.
