By virtue of and in execution of the Power of Sale contained in certain Mortgages and Security Agreements given by Manna, Inc. to Machias Savings Bank dated August 2, 2007 and July 28, 2008 and recorded in the Penobscot Registry of Deeds, Book 11078, Page 1 and Book 11482, Page 119, respectively, for breach of the conditions of said mortgages and for the purpose of foreclosing the same there will be sold at a public sale at 10:30 a.m. on October 6, 2016 at 629 Main Street, Bangor, Maine to wit: Real and personal property located at 629 Main Street, Bangor, Maine [u]Personal property included in the sale[/u]: At such sale, by virtue of and in execution of the rights and remedies of the Bank, as secured party, under said Mortgages and Security Agreements dated August 2, 2007 and July 28, 2008, and recorded in the Penobscot Registry of Deeds in Book 11078, Page 1 and Book 11482, Page 119, respectively, for default and breach of the condition of the Mortgages and Security Agreements there will be sold at said public auction described above all of the Debtor's fixtures, furniture, furnishings, machinery, equipment, and intangible personal property located on the premises (the "personal property"). [u]Terms of Sale[/u]. The sale will be conducted as a public auction, with bids being made orally. Prospective bidders must register with the auctioneer prior to the sale and submit a deposit of $25,000 in cash or certified U.S. funds to be increased by the buyer to 10% of the purchase price within 5 business days of the auction. The premises and personal property will be sold to the highest bidder as to each and shall be subject to all encumbrances of record (if any) and all local and municipal taxes. The deposits of unsuccessful bidders will be returned immediately after the sale. The highest bid(s) for the real estate and personal property will sign a Purchase and Sale Agreement with Machias Savings Bank, which will require payment of the balance of the successful bid within 45 days thereafter. Machias Savings Bank will convey the real estate to the purchased by Quitclaim Deed without Covenant and will convey the personal property by Bill of Sale without Warranty.
